Motor vehicle accidents cause the loss of time, property, health and even life. Such accidents occur because of elements including driver error, negligence, manufacturing defects and dangerous weather. No matter what the specific cause or result, a crash can turn a normal day into a prolonged struggle. Speaking with a lawyer can help you sort out your rights, your options and your future.
The Devestating Consequences of Auto Accidents
With a life-altering incident happening at a moments notice, victims of auto accidents are put in a tenuous situation. Any day can become a prolonged struggle when one has been unexpectedly hurt. A good number of injuries from auto accidents are focused in the back and the neck areas, and due to the delicate nature of the spinal cord, it can take a few days for an injury to ‘set in’. Nerves run from the spine to other parts of the body, and if those nerves become damaged they can, in turn, cause painful sensations to whatever part of the body they are connected to.

The problem with these types of injuries is that many people do not understand what is happening to them or why it is occurring. Many doctors are reluctant to treat auto accident injuries due to the way insurance companies handle these incidents. In order to avoid paying for the medical care, insurance companies will frequently say the pain that people feel in their back is unrelated to the car accident. Unfortunately, that’s why it takes an experienced attorney, someone who has worked within New Jersey’s Personal Injury Protection System, to successfully pursue an auto claim in this state.
Accidents Can Happen to Anyone
Auto accidents can occur to anyone at any age, and are currently one of the main causes of injuries in New Jersey, the United States, and all of the developed world. Unlike what many people think, it is simply not reckless teenagers or elderly drivers who are involved in the majority of automobile accidents. 38% of all car accidents involved drivers between the ages of 35 and 54, encompassing a wide range of people who generally have years of experience on the road.
You may be a highly skilled, competent driver, but that doesn’t mean you won’t get into an accident. Other driver’s may not take the same amount of precaution as you, there’s almost nothing that can be done to keep you invulnerable to them. We’ve all witnessed dangerous maneuvers performed on the road which lead to, hopefully, nothing more than a traffic ticket. But, it happens all too often that the person who didn’t check their mirror when changing lanes or fails to use a turn signal, ends up striking another vehicle.
Make Sure You Follow Up With Care
When visiting family doctors experiences vary, but New Jersey’s confusing set of rules on the subject only complicate the matter further. If you have been in an auto accident, determined that you have been injured, and now want to go seek care for those injuries, how exactly does one go about that? Many family doctors do not want to see patients who have been in automobile accidents and deal with the complicated nature of insurance in order to get paid for their services.
Filing an Auto Claim in New Jersey
In addition, when New Jersey driver’s purchase automobile insurance, they are given the option to buy either a “Verbal Threshold” option or a “Zero Threshold” option. The Verbal Threshold is also known as the restricted right to make a claim. If you have selected the “Zero Threshold” option, there is no restriction on your ability to make a claim against the other driver for “noneconomic damages” or “pain and suffering”. But, if you have a “Verbal Threshold” policy and were injured in a car accident, you must submit a physician’s certificate stating that you have suffered one of the specific injuries or you cannot make a claim. The types of injuries which will qualify are death, dismemberment, a displaced fracture, the loss of a fetus, significant scarring or a permanent injury. This limits your options, and puts a greater burden on those hurt to “prove” their injuries. That’s why, when purchasing auto insurance in New Jersey, we always recommend for our clients to choose the “Zero Threshold” option if possible.

Automobiles Getting Safer But Still Dangerous
Over the past 15 years there has been a clear trend in the decrease of the overall number of automobile accidents, with nearly 50,000 less accidents annually in the State of New Jersey than in the late 1990’s. Auto manufacturers have added safety features such as rearview cameras, motion sensing and self-parking cars which have lessened the burden placed on drivers while other technological advances, such as cell-phones and texting, have increased distractions.
But, still according to the most recent statistics, in 2011 nearly 65,000 people in New Jersey were reported as being injured as a result of an automobile accident. Car accidents remain the fifth most leading cause of death nationally despite many of these positive trends, and will likely remain so for some time.
