Dealing with the consequences of automobile accidents can be overwhelming, especially if you are injured. New Jersey has specific guidelines which dictate how we determine fault in an accident and then what implications that has for receiving medical care. Finding out exactly what to do next once you’ve been hurt in a car accident isn’t something most people are familiar with. That’s why we’ve made some information available to help clear up certain aspects of the issues related to automobile injuries and explain what exactly an attorney can do to assist you.
The Devestating Consequences of Auto Accidents
Despite recent positive trends which show car accidents occurring less frequently, they remain the second leading cause of injury in the state of New Jersey. Put simply, anytime you put people in control of a four-ton metal object traveling at high speeds there is a potential for injury. In the case that such an event does occur, it can leave victims permanently affected with lingering problems.

That is why, when one has been hurt after being involved in an auto-accident, it is important to file an auto-claim through insurance that will help cover the costs of medical care. Hospital visits and any medical procedures are typically very expensive, which is why New Jersey set up the Personal Injury Protection (PIP) system to help pay for these costs. Driver’s who have been hurt are entitled to file a PIP claim that will cover their medical care.
But, insurance companies rarely make the process easy, with numerous requirements along the way. That’s why it’s best to contact an attorney who can assist you in filing your claim and pursue any potential compensation you may be entitled to. PIP weighs in on not just the cost of care, but in how it overall affects your life, your family and your career when determining what the monetary compensation might be.
New Jersey's System for Handling Auto Injuries
New Jersey passed AICRA (Automobile Insurance Comprehensive Reform Act) in 1998, which has been guiding Personal Injury litigation in the state ever since. AICRA sets out to define the process of compensating those who have been injured due to another’s negligence, specifically in the case of automobile accidents.
When someone gets hurt, they can make a claim for compensation based on certain pre- defined criteria as laid out in the act. These include medical expenses, or as defined by the law, “reasonable and necessary expenses for treatment or services as provided by the policy, including medical, surgical, rehabilitative and diagnostic services and hospital expenses.”
New Jersey Personal Injury Protection (PIP) Policies
The twelfth most expensive state in the country to buy auto-insurance, as of 2013, is New Jersey with an average cost of annual premiums at $1,697. One of the causes of this is that auto insurance customers are required by law to purchase Personal Injury Protection, or PIP, as part of their insurance policy. PIP was set up to pay the medical bills of victims who have been injured while in a car accident. So, if someone else is driving and they strike your car and injure you, up to $250,000 of your medical expenses will be paid for out of the your own PIP policy through your auto-insurance.
Purchasing the right PIP Insruance Policy
When people in New Jersey purchase auto-insurance, they are able to choose the amount of PIP (Personal Injury Protection) coverage they want. The most “basic” PIP option limits coverage to $15,000 per person per accident. This coverage is severely limiting and can be used up by one visit to the Emergency Room when multiple tests are done. The law provides that the maximum coverage that can be purchased is $250,000.00 for medical bills. While this may not be enough to cover all expenses form an accident, it is strongly recommended that you purchase the maximum medical coverage.
How Auto Insurance Handles Medical Claims
Unfortunately, though, auto insurance companies do not process their claims in the same way that health insurance providers do. Auto-insurance companies require preapproval for medical services and will not allow for electronic medical billing. Precertification is frequently denied by insurance companies for no good reason. It is not uncommon for auto insurance companies to refuse to pay their bills or force medical providers to retain legal representation just to get their invoices paid. This frequently leads many medical providers to simply not work with auto accident victims, as they are wary of how they will be compensated by auto-insurance providers.
That’s why, when you have been hurt in a car accident, its best practice to have an experienced professional help deal with the insurance companies. An attorney can help ensure your claim goes through with least amount of difficulties so you don’t get stuck being responsible for exorbitant medical bills.

Automobiles Getting Safer But Still Dangerous
Auto Accident Attorney Cherry Hill New JerseyOver the past 15 years there has been a clear trend in the decrease of the overall number of automobile accidents, with nearly 50,000 less accidents annually in the State of New Jersey than in the late 1990’s. Auto manufacturers have added safety features such as rearview cameras, motion sensing and self-parking cars which have lessened the burden placed on drivers while other technological advances, such as cell-phones and texting, have increased distractions.
But, still according to the most recent statistics, in 2011 nearly 65,000 people in New Jersey were reported as being injured as a result of an automobile accident. Car accidents remain the fifth most leading cause of death nationally despite many of these positive trends, and will likely remain so for some time.
