Personal Injury Legal Representation

Nobody likes getting hurt. For those out there who derisively scoff when someone has been injured, thinking that they must be “lucky” to have the opportunity to receive a settlement for their injuries, I offer to let them live in their shoes for a day. Let them deal with the constant, throbbing pains and the emotional struggles. Let them go through surgery, recovery, and the time lost at work and with their family. In fact, I’m sure that any injured person would trade places just to not have to endure what they went through.

But, no one can turn back time. When someone gets injured, filing a personal injury claim can be their best recourse to express and receive compensation. Nobody chooses to get injured, but when it does happen it’s best they review what their options may be should they then decide to proceed with a personal injury claim.

Getting Compensation For Your Injuries

There are no two injuries that are exactly alike, so in order to fully evaluate each claim, it’s important to know the nature and extent of the injuries suffered. When filing an injury claim in South Jersey, though, it’s important to know that you have various legal options available. The law states that a person, business, or entity whose actions (or inactions) have resulted in the injury of another individual has unfairly committed a tortious act and thus is legally liable for the injuries caused. While not handled within the criminal system, so no criminal penalties can be incurred, a victim can seek a monetary recovery for any of the damages they suffered. Among the areas which can be claimed for a recovery include pain and suffering, lost wages, out-of-pocket medical expenses and future loss of earning capacity.

South Jersey's Personal Injury Tort System

Tort law is what governs how Personal Injury Claims work, meaning that it was specifically set up to address a “civil wrong” that caused losses or suffering to another person. A personal injury tort is separate from the criminal justice system, meaning that they are handled on a “civil” level (i.e., prison time and criminal punishment is not possible). What they deal with are people who have caused harm to another individual due to negligence. It’s up to the lawyer handling the claim to legally prove that the action or inaction of one of the persons, corporation, or any other entity was the legally recognizable cause of the victim’s injury. Should they successfully demonstrate this, the victim who has suffered the injury then has the legal right to pursue a recovery for their losses and damages through a personal injury tort claim.

Don't Get Pushed Around by Insurance Companies

When a personal injury attorney first undertakes to represent a client relative to a potential personal injury claim where the client or a family member has been injured or killed as the result of the negligence of another, many considerations face that attorney. First, it is critical that the attorney gather as many facts as possible from the victim or the family regarding all of the events that were related to the accident, including what happened, the names and addresses of witnesses, photographs and the like. It is important to know that personal injury claims can be handled on a contingency fee basis. This means that if there is no recovery, no fee is due. IT IS IMPORTANT TO KNOW YOUR RIGHTS. DON'T BE PUSHED AROUND BY INSURANCE COMPANIES.
