Personal Injury lawsuits are a form of Tort law, which refers to one party unfairly committing a tortious act against another, resulting in loss or harm. The person or entity who has committed this act, in the legal system referred to as a tortfeasor, will have a legal liability for any of the damages they caused. Torts do not fall under criminal law, meaning that there is no criminal penalty for these actions. But, a victim is allowed to recover their damages through a form of monetary compensation. In personal injury cases, this means that an injured person can make a claim for areas such as medical expenses, lost wages, future earning capacity, and any out-of-pocket medical expenses. Claims for compensation can also be made for non-physical issues relating to the injury as well, such as pain and suffering or emotional damages.

The Difference Between Civil and Criminal Courts

Were the injury case to go to court, this matter would be handled in front through the Civil Court system. A civil case for which a jury is involved is generally a dispute between two or more parties that does not involve a criminal matter and is not a dispute between family members regarding divorce or child custody. In family matters, a judge handles the case without a jury. In a civil matter, in order for a plaintiff to win a case, it is only necessary for the plaintiff to prove his or her case by a preponderance of the evidence or in some cases by clear and convincing evidence. The judge will explain the meaning of those terms to the jury.

In a criminal matter, the defendant has a right to a trial by jury. The defendant is also constitutionally entitled to be presumed innocent of the charges until the jury finds otherwise. More proof is required to find a person guilty of a crime than to return a verdict for a plaintiff in a civil case. In order to return a verdict of guilty in a criminal trial, the charges must be proven beyond a reasonable doubt.

Does a Personal Injury Claim Mean I have to go to Court?

The great majority of personal injury claims are actually settled out of court. That doesn’t mean that it’s impossible for the claim to end up in trial, that can happen if a settlement isn’t reached. When a settlement figure is agreed upon, that doesn’t mean that it would be lower had the claim gone to trial.
In fact, most studies show the figures are usually about the same. The settlement itself is based upon what each parties’ expectations for settlement would have been, that is how the sum is created. But, when considering trials versus settlements, you must take into account the time, money and aggravation spent going to trial. That’s why, for both sides, it’s usually a more agreeable outcome to have the matter negotiated into a settlement.
