Personal Injury Legal Representation

If you or a loved one has been injured, it can be a difficult and traumatic situation for all those affected. Everyone has trouble navigating the litany of legal, employment and insurance issues that may arise from such an unexpected incident. And unfortunately, the State of New Jersey has some of the most restrictive laws in regard to how auto-insurance companies are able to deny coverage and care to those who are in legitimate need, adding to the burden. That is why, with today’s complicated legal world, it is important to have an attorney fighting for you.

The American Personal Injury System

Tort laws in the United States were initially underdeveloped and heavily influenced by English law. It wasn’t until the 1880’s when Oliver Wendell Holmes, Jr. attempted to give torts a coherent legal structure. Since then, personal injury law has been a cornerstone of the American legal system. Torts attempt to right a civil wrong, in the case of a personal injury claim, an injured victim seeking damages or compensation from those who are responsible for their injuries. Tort cases involving injuries attempt to compensate a person for what they have lost, allowing the victim to seek a monetary compensation for their injury. There are several areas for which a victim can make a claim for compensation, including; loss of earning capacity, medical expenses, pain and suffering, or future out-of-pocket medical expenses.

Does Filing a Claim Mean I Have to go to Court?

The great majority of personal injury claims are actually settled out of court. That doesn’t mean that it’s impossible for the claim to end up in trial, that can happen if a settlement isn’t reached. When a settlement figure is agreed upon, that doesn’t mean that it would be lower had the claim gone to trial.

In fact, most studies show the figures are usually about the same. The settlement itself is based upon what each parties’ expectations for settlement would have been, that is how the sum is created. But, when considering trials versus settlements, you must take into account the time, money and aggravation spent going to trial. That’s why, for both sides, it’s usually a more agreeable outcome to have the matter negotiated into a settlement. While we are speaking in generalities, should our firm feel that going to trial is the best course of action for our clients, we are more than prepared to do so. John Morelli has had great success in pursuing personal injury claims in front of a jury, he is a certified trial attorney, a designation less than 2% of attorneys in New Jersey achieve.
