Nobody likes getting hurt. For those out there who derisively scoff when someone has been injured, thinking that they must be “lucky” to have the opportunity to receive a settlement for their injuries, I offer to let them live in their shoes for a day. Let them deal with the constant, throbbing pains and the emotional struggles. Let them go through surgery, recovery, and the time lost at work and with their family. In fact, I’m sure that any injured person would trade places just to not have to endure what they went through.

But, no one can turn back time. When someone gets injured, filing a personal injury claim can be their best recourse to express and receive compensation. Nobody chooses to get injured, but when it does happen it’s best they review what their options may be should they then decide to proceed with a personal injury claim.

Getting Compensation For Injuries

Lawsuits for personal injury claims are different than those in areas such as criminal law. While an injury claim can be made against a criminal act, they are filed in the tort system and thus cannot result in any criminal penalties. The tort system was set up to deal with issues when one person, business or other entity has unfairly committed an act against another individual, resulting in damages or harm.

A victim who has filed a successful tort claim will be able to seek a monetary recovery for any of the damages they sustained as a result of the other’s actions. There are several areas upon which a personal injury claim can be based, including past medical expenses, future medical expenses, loss of earning capacity and wages, emotional issues, or pain and suffering. No two injuries are exactly alike, though, so each claim should be evaluated on a case-to-case basis depending on the circumstances involved.

Compensation for Damages from Injuries

Personal injury lawyers can help ensure that their clients receive the maximum amount of damages recoverable by law. Some of the items for which injured parties are legally entitled to compensation include past and future lost wages; past and future medical expenses; damages for both physical and emotional pain and suffering, again both past and present; and damages for disfigurement.

Sometimes, a close family member of the injured person, such as his or her spouse, may also be entitled to damages, often referred to "loss of consortium damages," which are intended to compensate the loved one for the loss of the injured party's services and companionship.

How Much of a Difference does an Attorney Make?

You’ve been hurt and are injured, but do you really need to retain the services of an attorney? The benefits of hiring a lawyer are proven, especially in personal injury claims.

For injured people who obtained an attorney to represent their claim, statistics have shown that they received substantially higher gross recoveries. For those who chose not to have an attorney represent them on their claim, they generally received significantly smaller recoveries than if they had a lawyer. They might not have been able to fully cover lost wages, economic losses, and medical expenses. The effect that a lawyer has in receiving compensation for injuries is quantifiable and well-founded, especially when handling insurance companies.

Further Resources About Personal Injury

I like to tell my clients that an informed person is an empowered one. That’s why I’d like to make available additional resources so you can have a good idea about what you should expect once you begin your personal injury case. There are a litany of issues related to Personal Injury Law, it’s not something I would expect anyone outside of an attorney to have knowledge of. Take some time before you start your case to sit down and read about what you can expect next.
