Personal Injury Legal Representation

Nobody likes getting hurt. For those out there who derisively scoff when someone has been injured, thinking that they must be “lucky” to have the opportunity to receive a settlement for their injuries, I offer to let them live in their shoes for a day. Let them deal with the constant, throbbing pains and the emotional struggles. Let them go through surgery, recovery, and the time lost at work and with their family. In fact, I’m sure that any injured person would trade places just to not have to endure what they went through.

But, no one can turn back time. When someone gets injured, filing a personal injury claim can be their best recourse to express and receive compensation. Nobody chooses to get injured, but when it does happen it’s best they review what their options may be should they then decide to proceed with a personal injury claim.

South Jersey Personal Injury Law

Although rules differ from state to state, South Jersey is much like the rest of America in providing injured victims with the right to seek monetary compensation for their injuries through a personal injury tort case. Tort cases are different from criminal trials that you so often see on TV, as a tort will attempt to rectify a civil wrong committed by one person, business or entity against another individual. New Jersey’s legal system recognizes that, should someone cause harm to another, they can be found legally liable for those injuries that they inflicted. When someone is found liable for the injuries of another person, the victim has a right to seek monetary for the damages related to the accident. There are several areas in which a victim has a right to claim damages, including, but not limited to; medical expenses, pain and suffering, lost wages, and lost earning capacity.

Does Having an Attorney Reall Make a Difference?

If you’ve been hurt, it can be a difficult to decision to make; should you now contact an attorney and seek to file a personal injury claim? There are tangible benefits to hiring an attorney, as statistics show that those who retained a lawyer generally received much higher gross recoveries than those who did not. Some people choose to represent themselves, which is possible but not recommended.

But stats show that people who represent themselves got much lower compensation than those with an attorney. Receiving less compensation means that it’s possible to not be able to fully cover any economic losses, medical expenses, or lost wages. The overall effect that an attorney has in getting their client’s properly compensated is quantifiable, particularly when insurance companies are involved.

Motor Vehicle Accidents

Car accidents are a major component of personal injury law because they occur so alarmingly often. The United States in general has roads that are more dangerous than most other countries, with 11.4 road deaths per 100,000 people (compared to 5.5 for Europe). Because of this problem, personal injury cases involving car accidents are common with about 17, 589 accidents occurring each day and 2.9 million injury cases every year. A personal injury lawyer can help ensure that, once in an accident, their client gets their benefits paid for and isn’t left with exorbitant out-of-pocket expenses. In addition to that, proving fault in an accident can be tricky, especially if the other driver disputes it. That’s why it’s best to have an attorney arguing your auto accident case on your behalf.

Slip, Trip and Fall Injuries

Slip and falls are a major hazard for businesses and owners, as it’s something that they should aware of during the construction and planning of any building. If a business is open, wherever people go, it must be safe for them to be there. If conditions are unsafe and leads to an injury, that is the fault of the property owner for their failure to ensure adequate safety. There are numerous ways in which a property can be rendered unsafe, such as a crumbling curb or step or a failure to clear ice or snow. Black ice spots are a particular hazard during wintertime, but property owners are supposed to know that they must salt and clear any ice that could be hazard. If someone were to slip and fall on the ice, it would be the fault of the property owner for their failure to clear away the hazard.

Other Types of Injuries

There are many other injuries which people may seek legal representation for, not falling neatly within any of these predefined categories. People get hurt through the fault of another in countless ways, such as through a defective product or as a pedestrian in a road accident. For victims involved in these types of catastrophic injuries, unsure of what your legal options may be, it’s important you call and talk to a lawyer about seeking representation. Anytime you get hurt and think another person might have been the cause, talking with a lawyer is the only way to know for sure how they can help.
